1. Agreement to Terms

By accessing or using P.KYE("the App"), you agree to be bound by these Terms of Service("Terms"). If you do not agree to these Terms, do not use the App. These Terms constitute a legally binding agreement between you and A2-83 Limited.

2. Description of Service

P.KYE provides pollen forecast information and allergen tracking features. The service includes:

•     Real-time pollen level data for your location

•     5-day pollen forecasts

•     Tracking of 15 specific plant species (Trees, Grasses, Weeds)

•     Personalised allergen trigger tracking

•     Daily notifications based on your marked triggers (subscription required)

•     Health recommendations for managing high pollen days

3. Subscription Terms

3.1 Pricing

•     Monthly Subscription: £3.99 per month (Prices are in GBP and may vary by territory (USD, EUR, AUD, NZD equivalent).

3.2 Payment and Billing

•     Subscriptions are charged through Apple In-App Purchase (iOS) or Google Play Billing (Android).

•     Payment is charged to your Apple ID account or Google Play accountat confirmation of purchase.

•     Subscriptions automatically renew unless cancelled at least 24 hours before the end of the current period.

•     Your account will be charged for renewal within 24 hours prior tothe end of the current period.

•     You can manage and cancel your subscription in your device'saccount settings.

3.3 Cancellation

•     You may cancel your subscription at any time.

•     To cancel on iOS: Go to Settings > Subscriptions > P.KYE> Cancel Subscription

•     To cancel on Android: Go to Google Play Store > Menu >Subscriptions > P.KYE > Cancel Subscription

•     Cancellation takes effect at the end of your current billing period.

•     You will retain access to paid features until the end of the current billing period.

•     No refunds are provided for partial subscription periods.

3.4 Refunds

•     Refund requests are handled by Apple Inc. or Google LLC per their respective policies.

•     We do not directly process refunds.

•     For refund inquiries on iOS: Contact Apple Support at support.apple.com

•     For refund inquiries on Android: Visit play.google.com/store/account

•     Eligibility for refunds is determined solely by Apple or Google.

4. User Accounts

•     No user accounts are created

5. Acceptable Use

You agree NOT to:

•     Use the App for any illegal purposes or in violation of any laws

•     Attempt to hack, reverse engineer, decompile, or disrupt the App

•     Share your subscription with others or create unauthorized accounts

•     Scrape, copy, or download data from the App using automated means

•     Use the App to spam, harass, or harm others

•     Impersonate others or provide false information

•     Interfere with other users' enjoyment of the App

•     Circumvent or attempt to circumvent any security features

6. Medical Disclaimer

IMPORTANT - PLEASE READ CAREFULLY:

P.KYE is for informational purposes only and is NOT a substitute for professional medical advice, diagnosis, or treatment.

•     The App does not provide medical advice or diagnose conditions.

•     Always seek the advice of a qualified healthcare provider for any medical questions or concerns.

•     Never disregard professional medical advice or delay seeking it because of information from the App.

•     Do not rely solely on the App for medical decisions regarding allergy management.

•     In case of a medical emergency, call emergency services immediately.

•     The App is not intended to treat, cure, or prevent any disease.

•     Pollen forecasts are estimates and may not reflect actual conditions you experience.

7. Data Accuracy

•     Pollen data is provided by Google Pollen API and other third-party sources.

•     We strive for accuracy but cannot guarantee 100% accurate forecasts.

•     Pollen levels are estimates based on available data and may vary from actual conditions.

•     Local variations may occur due to microclimate factors not captured by forecasts.

•     We are not liable for decisions made based on pollen forecasts.

•     Always use your own judgment and consult healthcare providers formedical decisions.

8. Intellectual Property

•     The P.KYE App, including all content, features, and functionality, is owned by A2-83 Limited.

•     "P.KYE" trademark and logo are owned by A2-83 Limited.

•     Pollen data is provided by Google LLC and is subject to Google'sterms.

•     You are granted a limited, non-exclusive, non-transferable license to use the App for personal use.

•     You may not copy, reproduce, distribute, modify, or create derivative works from the App.

•     Unauthorized use may result in termination of your license and legal action.

9. Third-Party Services

The App uses third-party services:

•     Google Pollen API (subject to Google's Terms of Service: https://policies.google.com/terms)

•     Apple In-App Purchase (subject to Apple's Terms: https://www.apple.com/legal/internet-services/itunes/)

•     Google Play Billing (subject to Google Play Terms:https://play.google.com/intl/en-US/about/play-terms/) You agree to comply with all applicable third-party terms when using these services through the App.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

•     WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.

•     This includes damages for loss of profits, revenue, data, or use.

•     OUR TOTAL LIABILITY IS LIMITED TO THE AMOUNT YOU PAID FOR THE SUBSCRIPTION IN THE 12 MONTHS PRECEDING THE CLAIM.

•     We are not liable for health outcomes or decisions made based on App information.

•     We are not responsible for third-party service failures (GoogleAPI outages, etc.).

•     Some jurisdictions do not allow limitations on liability, so these may not apply toyou.

11. Warranty Disclaimer

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We disclaim all warranties, including but not limited to:

•     Implied warranties of merchantability and fitness for a particular purpose

•     Warranties that the App will be error-free, uninterrupted, or secure

•     Warranties regarding accuracy, reliability, or completeness of content

•     Warranties that defects will be corrected Use of the App is at your own risk.

12. Termination

We may suspend or terminate your access to the App if you:

•     Violate these Terms of Service

•     Engage in fraudulent activity or payment disputes

•     Misuse the App or compromise security

•     Fail to pay subscription fees Upon termination:

•     Your right to use the App ceases immediately

•     We may delete locally stored app data in accordance with our Privacy Policy.

•     Sections of these Terms that by nature should survive termination will remain in effect

13. Changes to Terms

We may modify these Terms at any time. We will notify you ofmaterial changes via:

•     In-app notification

•     Email notification (if email address provided)

•     Notice in App Store or Google Play listing update

Posting updated Terms with new "Last Updated" date Changes become effective immediately upon posting. Continued use of the App after changes constitutes acceptance of the updated Terms.

14. Governing Law and Jurisdiction

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles. Any disputes arising from these Terms or use of the App shall be resolved in the courts of England and Wales. You agree to submit to the exclusive jurisdiction of these courts.

15. Dispute Resolution

Mediation First:

•     Parties agree to attempt mediation before pursuing litigation. For qualifying claims, small claims court may be available as an alternative.

•     Court Resolution:

•     Disputes will be resolved through the courts of England and Wales.

16. Consumer Rights (UK)

Nothing in these Terms affects your statutory rights under the Consumer Rights Act 2015 or other applicable UK consumer protection laws. If you are a consumer in the UK:

•     Digital content must be as described, fit for purpose, and of satisfactory quality

•     You may be entitled to a repair, refund, or price reduction if digital content is faulty

17. Force Majeure

We are not liable for failure to perform obligations due to circumstances beyond our reasonable control, including:

•     Natural disasters, pandemics, or acts of God

•     Government actions, war, terrorism, or civil unrest

•     Internet or telecommunications failures not caused by us

•     Third-party service provider failures (e.g., Google API outages)

•     Labour disputes or strikes

18. Export Compliance

The App may not be used or exported in violation of United Kingdom, European Union, or United States export laws or regulations.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction:

•     That provision will be limited or eliminated to the minimum extent necessary

•     The remaining provisions will remain in full force and effect

•     The invalid provision will be replaced with a valid provision that most closely matches the intent

20. Entire Agreement

These Terms, together with our Privacy Policy,constitute the entire agreement between you and A2-83 Limited regarding use ofthe App. These Terms supersede any prior agreements, communications, orunderstandings, whether oral or written.

22. Apple-Specific Terms (iOS Users)

If you access the App via Apple iOS:

•     These Terms are between you and A2-83 Limited, not Apple.

•     Apple has no obligation to provide maintenance or support for the App.

•     Apple is not responsible for addressing any claims related to the App.

•     In case of third-party intellectual property infringement claims, Apple will not be responsible.

•     Apple and its subsidiaries are third-party beneficiaries of these Terms.

•     Upon your acceptance of these Terms, Apple has the right to enforce them against you.

23. Google Play-Specific Terms (Android Users)

If you access the App via Google Play:

•     These Terms are between you and A2-83 Limited, not Google.

•     Google has no obligation or liability with respect to the App or these Terms.

•     Google is not responsible for addressing any claims related to theApp.

24. Service Availability

We do not guarantee uninterrupted availability of the App and may temporarily suspend services for maintenance, updates, or technical issues.

BY USING P.KYE, YOU ACKNOWLEDGE THAT YOU HAVE READ, UNDERSTOOD, AND AGREE TO BE BOUND BY THESE TERMS OF SERVICE. YOU ALSO ACKNOWLEDGE THAT YOU HAVE READ AND UNDERSTOOD OUR PRIVACY POLICY. IF YOU DO NOT AGREE TO THESE TERMS, YOU MUST NOT USE THE APP.
